In a public-private partnership, project risks are allocated with regard to each party’s ability to manage them. Design, construction and operations may sit largely with the private partner, while site access, consents, demand and revenue, change in law and force majeure require more specific treatment. Their allocation and the available relief depend on the risk category, delivery model, governing law and contract.

A lender technical adviser provides independent technical due diligence on the project’s assumptions, delivery arrangements and technical risks to inform the financing decision.
